Draft Prospect Harbor Space Force Station (PHSFS) Performance Work Statement (PWS) for Review and Comment



Reference: RFI Number: FA2550PH23195



a. The requirement is for Base Operations Support (BOS) services at the future Prospect Harbor Space Force Station (unofficial name), located in Maine. The contract is planned as a Government Owned Contractor Operated (GOCO) arrangement, which means the BOS contractor will be responsible for the operations of the station, and there will be no station military commander or civilian director at the performance location.



b. The acquisition strategy for this requirement has not been determined yet. A draft copy of the Prospect Harbor Space Force Station (PHSFS) Performance Work Statement (PWS) may be requested for the purpose of review and submitting comments and suggestions to the Government. The draft PWS is Controlled Unclassified Information (CUI). To request a copy of the document, Contractors must have " A - Active" status on the Joint Certification Program (JCP) Certification website.

At the JCP website, select the "JCP Customer User Manual" for information on accessing the site, and select "Register" to gain access to the website.



c. If the requester's JCP status is " A - Active," send an e-mail request for the draft PWS to:

The PWS will be sent using DOD SAFE; the requester will receive a DOD SAFE system e-mail with the URL to use to access the PWS file.

e. Agreement for use of Draft Prospect Harbor Space Force Station (PHSFS) Performance Work Statement (PWS)



By requesting and receiving a copy of the draft PWS, the requester agrees to protect the unclassified PHSFS draft PWS as follows:



Store and ransmit the document using equipment and systems suitable for CUI information;



The document will not be stored on a publicly accessible website or other location available to unauthorized users;



The document will be used only (a) for review purposes to provide the Government with comments or suggestions, which may be used by the Government to improve the requirement at its discretion, (b) for evaluation of possible participation in a competitive acquisition for the Government's requirement, (c) and for evaluation by potential subcontractors or teaming partners for the same purposes.



Any use of the document by other Contractors (potential subcontractors or teaming partners) is subject to the same terms of this agreement.



f. The draft PWS a draft requirement document only. Any response to this notice is voluntary and the Government will not pay for any response submitted. This notice should not be considered a commitment on the part of the Government to award a contract; the Government will not be liable for any costs incurred in anticipation of a contract. All responses to this notice will be kept by the government. No contract will be awarded from this notice.



g. The following Ombudsman clause applies to this notice.



5352.201-9101, Ombudsman (Oct 2019 )



(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.



(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).



(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, AFICC/OL-SPC Director or Deputy Director of Contracting, 250 Peterson Blvd, Ste 315, Peterson AFB, CO 80914, (P) 719-304-4143 or 719-314- 6917, Workflow e-mail: afica.ks.wf@us.af.mil. Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/DRU/SMC ombudsman level, may be brought by the interested party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431.



(d) The ombudsman has no authority to render a decision that binds the agency.



(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.

h. No certification of funds for the subject requirement are available at present; therefore, the following statement applies to this acquisition:



Notice to Offeror(s)/Supplier(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.
